A recent Globe & Mail <\/em><\/strong>article highlighted an oft-overlooked estate planning risk: the lost will. In the case of Finsant Estate (2024),1<\/sup><\/em> a will prepared in 2001 named the deceased\u2019s grand-niece as the sole beneficiary. While the will could not be located, the assumed beneficiary asked the court to enforce it, and the estate\u2019s administrator claimed the deceased had died without a will.<\/p>\n

If a will is known to exist but is lost, \u201cclear and convincing evidence\u201d is required to validate it. Otherwise, it may be presumed to have been deliberately destroyed by the deceased. In this case, the court declared the estate \u201cintestate,\u201d meaning assets were distributed according to provincial law.<\/p>\n
